We are Ubicquia, Inc. (“UBICQUIA,” “We,” “Us,” “Our”), located at 401 East Las Olas Blvd., Suite 800, Fort Lauderdale, FL 33301 United States of America.
You (“You,” “Your”) are a User of Our Website and/or Services.
We care about how Your personal information is used and shared, and We respect Your right to privacy. We recognize that You, as a User of Our Website and/or Services, need to understand and control the uses of Your personal information. This Privacy Policy describes Our collection of information in connection with Your use of Our Website and/or Services, and explains how We use and share this information.
1. ACCEPTANCE OF THIS PRIVACY POLICY
Your use of Our Website and/or Services, including any dispute concerning privacy, is subject to this Privacy Policy and the UBICQUIA Website Terms and Conditions of Use. BY USING OUR WEBSITE AND/OR SERVICES, YOU ARE ACCEPTING THE PRACTICES SET OUT IN THIS PRIVACY POLICY AND THE UBICQUIA WEBSITE TERMS AND CONDITIONS OF USE.
2. DEFINITIONS
- “Affiliate” means any entity, now or hereafter existing, that directly, or indirectly through one or more intermediaries, controls, is controlled by, or is under common control with You or UBICQUIA, as applicable. “Control,” for the purposes of this definition, means direct or indirect ownership or control of more than 50% of the voting interest in the subject entity.
- “Content” includes, but is not limited to, processor-executable software, human and/or machine readable software in any computer programming language, information, works, databases, text, audio, images, graphics, video, tactile data, Metadata, and other machine-generated and machine-presentable information.
- “Industrial Device Services” means processor-executable software operating over the Internet in a client-server architecture to collect, aggregate, and deliver data associated with network-connected industrial devices (such as Internet-of-Things (IoT) devices or industrial IoT (IIoT) devices, or operational technology (OT) devices); processor-executable software operating over the Internet in a client-server architecture to control network-connected industrial devices; ; processor-executable software operating over the Internet in a client-server architecture to monitor various operational characteristics of network-connected industrial devices; and processor-executable software operating over the Internet in a client-server architecture to analyze data collected by network-connected industrial devices, report such data and/or analysis, and/or visualize such data and/or analysis, including but not limited to UBICQUIA’S UbiVu® cloud-based asset management and data analytics platform.
- “Mail” means electronic mail (e-mail or email), physical postal mail passed through a government-controlled mail delivery provider, or envelope or package delivery provided by an internationally recognized courier. For the avoidance of doubt, the U.S. Postal Service is an example of a government-controlled mail delivery provider, and United Parcel Service® or Federal Express (FedEx) is an example of an internationally recognized courier .
- “Metadata” means data, alone or in a set, that describes, in whole or in part, and provides information about other data. For example, and not limitation, Metadata for an image may include a size of the picture, color or colors, intensity, image resolution, creation date, copyright holder, an identifier of the capturing device, description of the image content, and the like. For example, and not limitation, Metadata for a web browser may include browser’s type and version, default search engine, a color scheme, a frequency at which web pages are surfed or viewed, an operating system, a computing device platform, pages of a website visited along with the time and date of such visit and/or the time spent on those pages, an internet service provider, and the like.
- “Personally Identifiable Information” means information that can be linked to an individual. A non-exhaustive list of information that can be linked to an individual includes a person’s name, a person’s phone number, a person’s non-business, non-governmental address, a person’s non-business, non-governmental email address, a person’s non-business, non-governmental organization, and a person’s non-business, non-governmental title.
- “Services” means Website Services and/or Industrial Device Services, and in relation to products and services provided by UBICQUIA, information or data collection, time-limited information or data storage, and/or information or data delivery.
- “User” means any human that accesses, uses, or in any other way interacts with UBICQUIA’S Website and/or UBICQUIA’S Services. In the context of this Privacy Policy, if You access, use, or in any other way interact with Our Website and/or Services, You are a User.
- “Website” means www.ubicquia.com and any derivative websites in any country in the world, including all of their Content, along with any other websites, including mobile websites or websites particularly arranged to deliver content to mobile devices such as smartphones, tablets, body-worn devices, and the like, that provide the Website Services or through which the Website Services are provided, used, accessed, or interacted with, along with the Content of such websites, which websites are hosted, administered, populated, or otherwise provided by or at the direction of UBICQUIA or its Affiliates.
- “Website Services” means processor-executable software operating over the Internet in a client-server architecture to provide any one or more of data collection, data aggregation, data processing, data analysis, data delivery or display, and the like automatically or under manual or programmatic control, but not to provide any consumer or consumer-oriented e-commerce or other services.
3. PERSONALLY IDENTIFIABLE INFORMATION WE COLLECT
We receive and store any information You voluntarily enter on, into, or through Our Website and/or Website Services or otherwise provide to Us (e.g., by filling out a form, providing feedback, requesting additional information), including information that is generated by Your interaction and activities when using Our Website.
4. COLLECTION OF PERSONALLY IDENTIFIABLE INFORMATION
Methods We may use to collect Personally Identifiable Information include:
- “Contact Requests/Program Registration/Demo Requests/Other Information Requests.” If You choose, You may request product information and/or a live demonstration, request to sign up for a program or webinar that We offer, and/or request that We contact you. You may also elect to respond to a survey We offer regarding our products and/or services. When You do any of the foregoing, We may require that You supply a first and last name, email address, and state of residence. In some cases, We may also request additional contact information, such as a full address, a phone number, and/or information regarding the company on whose behalf You are contacting Us. We may execute algorithms on the input You provide to, for example, verify the authenticity of a format for the data or otherwise. For example, and not limitation, We may algorithmically determine that an alleged email address You enter includes first and second portions separated by an “@” and ending with a known domain extension.

We may also collect and store information relating to Your Internet service provider and/or Your Internet Protocol address (“IP Address”), which is an Internet-wide unique string of numbers assigned to your computing device by, for example, Your media access control address (“MAC address”), which is a unique identifier conventionally assigned to a network interface controller (“NIC”) for use as a network address at the physical layer.
- “Cookies.” A “cookie” is a small data file that can be placed in Your computing device’s non-volatile memory when You visit certain websites. We may use cookies supplied by Your browser or by third-party add-ins, such as Adobe® Flash®. We currently only use “session cookies” which help Us ensure that You are recognized as You move from page to page within Our Website and/or Website Services.

Our Website and/or Services are intended for use by representatives of entities who are interested in the products and services we offer. We do not direct our Website or Services to anyone who is not an adult. We do not knowingly collect any Personally Identifiable Information from any person considered in the applicable jurisdiction to be a minor.

UBICQUIA takes industry-standard, reasonable security measures to prevent the loss, misuse, and alteration of the information under Our control, which includes Your Personally Identifiable Information. We will exercise industry-standard, reasonable care to provide secure transmission of information between Your computing device and the web servers that host Our Website and/or Website Services. We cannot and do not ensure or warrant the security of any information transmitted to Us over the Internet, and We cannot and do not accept any liability for any unintentional disclosure.

Our Website and Services are hosted in, and provided from, the United States. If You use Our Website and/or Website Services from another region that has laws governing data collection and use that may differ from U.S. law, You understand that You are transferring Your information, including Your Personally Identifiable Information, to the United States.
